30/06/11 – The Court of Justice of the European Union (CJEU) delivered its decision on the “Zeturf Ltd v Premier minister” case concerning the French monopoly for the management of off-course betting on horseracing. In its judgement, the Court recalls that Member States are free to set the objectives of their policy on betting and gaming, and where appropriate, to define the level of protection sought. With regards to the question whether the online and offline sectors should be considered separately when assessing the restrictions to the free provision of services, the Court points out that “the internet constitutes a simple channel through which games of chance may be offered”.
